Terms of Service

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are agreeing to these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for property managers, property owners, tenants, vendors, and their authorized staff - not for children.

The Service provides different portals and permission levels for staff, property owners, tenants, and vendors. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

If you are a property-manager customer, you are solely responsible for the accuracy, legality, and appropriateness of all tenant, owner, vendor, lease, financial, and other data you upload to or collect through the Service, and for obtaining any consents required by law (including SMS consent under Section 12) before providing that data to us. We process this data on your behalf as described in our Privacy Policy.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable housing, consumer protection, or telecommunications law;
• Upload data you do not have the right to share;
• Send text messages, emails, or calls through the Service without the required consent or legal basis;
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems;
• Reverse engineer or misuse the Service's AI features to generate unlawful, discriminatory, or deceptive content.

The Service includes AI-powered features, including an AI phone and messaging assistant, AI lease document extraction, and AI-generated summaries and suggestions. AI output may be inaccurate, incomplete, or unsuitable for your specific situation, and must be reviewed by the property manager or other responsible human before being relied upon. AI output is provided for informational and operational assistance only and does not constitute legal, tax, financial, or professional advice. You are responsible for verifying AI-assisted decisions and communications before acting on them.

The Service integrates with third-party providers to deliver certain functionality, including payment processors, tenant screening providers, Plaid (for bank account linking and income verification), messaging and voice carriers, and third-party property management system (PMS) integrations (e.g. AppFolio, Buildium, Yardi). Your use of these integrations may also be subject to that provider's own terms. We are not responsible for the acts or omissions of third-party providers.

Fees for the Service are described in your order form, subscription plan, or as otherwise agreed in writing. Fees are non-refundable except as required by law or expressly stated otherwise. We may change our fees with advance notice as described in your subscription terms.

We retain all right, title, and interest in and to the Service, including all software, design, and content we provide, excluding data you upload. You grant us a license to use your data solely to provide and improve the Service for you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENT GENIE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

"Rent Genie" is Rent Genie's text messaging program. Every message begins with "Rent Genie:". Recipients include tenants, applicants and prospects, property owners, vendors, and property-manager staff who opt in.

Message types include: rent/invoice and payment reminders, payment receipts, late-fee notices, maintenance ticket updates and scheduling, vendor job dispatch, tour/showing confirmations, application and lease/renewal notices, inspection scheduling, and one-time login verification codes. All messages are transactional; we do not send marketing or promotional messages through this program.

You may reply to any message; replies are answered by property-manager staff or an AI assistant on their behalf.

Consent to receive these messages is optional, collected via an unchecked checkbox at each of the following points: SMS program page opt-in form, Tenant portal sign-up, Rental application form, Tour / showing booking form, Account settings (staff and vendor portals), Vendor portal sign-up, Marketplace vendor sign-up, Team invitation acceptance. Consent to receive text messages is never a condition of renting, applying, paying, or using the service.

Reply STOP at any time to opt out, HELP for help, or START to resubscribe. Message frequency varies. Msg & data rates may apply.

Carriers are not liable for delayed or undelivered messages.

You agree to indemnify and hold Rent Genie harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including your failure to obtain required consents from individuals whose data or phone numbers you upload or message through the Service.

We may suspend or terminate your access to the Service for violation of these Terms or non-payment. You may terminate your account at any time as described in your subscription terms. Provisions that by their nature should survive termination (including Sections 9-13) will survive.

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles.

We may update these Terms from time to time. We will update the "Effective" date above and, for material changes, provide reasonable notice. Continued use of the Service after a change constitutes acceptance.
